Terms of Service

These Terms and Conditions (the “Terms”) govern your use of the Who’s Your Data? LLC website, webforms, communications, and related services (collectively, the “Services”). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Use of the Website

You may use our website and Services only for lawful purposes and in accordance with these Terms. You agree not to interfere with website operation, attempt unauthorized access to our systems, submit false or misleading information, transmit malicious code, or use the Services in a manner that violates applicable law or another person’s rights.

Consent to receive calls or text messages is not a condition of purchasing goods or services. Message frequency varies based on your activity, requests, account status, and communications you choose to receive. Message and data rates may apply.

To stop recurring SMS messages, reply STOP to any message. You may receive one final confirmation message after opting out. For help, reply HELP to a message or contact us using the information below. You must notify us if you change or deactivate your mobile number.

LLC and are protected by applicable intellectual-property laws. You may not copy, reproduce, modify, distribute, publicly display, or create derivative works from website content without our prior written permission, except as allowed by law.

To the fullest extent permitted by law, Who’s Your Data? LLC and its owners, officers, employees, contractors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, revenue, profits, goodwill, or business opportunity arising out of or related to your use of, or inability to use, the Services.

To the fullest extent permitted by law, our total liability for any claim arising from or related to the Services will not exceed the greater of the amount you paid us for the applicable Services during the twelve months before the event giving rise to the claim, or one hundred U.S. dollars (US $100).

10. Indemnification

You agree to defend, indemnify, and hold harmless Who’s Your Data? LLC and its owners, officers, employees, contractors, and agents from claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising from your violation of these Terms, your misuse of the Services, or your violation of applicable law or another person’s rights.

11. Governing Law and Venue

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles. To the extent permitted by law, any dispute arising from or related to these Terms or the Services must be brought exclusively in the state or federal courts located in Washington State, and you consent to those courts’ jurisdiction and venue.

12. Changes to These Terms

We may revise these Terms at any time by posting an updated version on this website and changing the effective date. Your continued use of the Services after the revised Terms are posted constitutes acceptance of the updated Terms, to the extent permitted by law.
